Establishment of lineage in an invalid (fasid) nikah
Question
Question: Concerning the establishment of lineage (nasab) of children born after a nikah with a woman who received a major (mughallaza) divorce, without tahlil (without her first having been married to another), the following several texts have come to my notice: [ar](١) ولو طلقها ثلاثًا ثم تزوجها قبل أن تنكح زوجًا غيره فجاءت منه بولد ولا يعلمان بفساد النكاح فالنسب ثابت، وإن كان يعلمان بفساد النكاح ثبت النسب أيضًا عند أبي حنيفة رحمة الله عليه، كذا في التتارخانية ناقلًا عن تجنيس الناصري[/ar] (1)
Answer
A nikah with a woman who received a major (mughallaza) divorce, without tahlil, is a doubt as to the contract (shubhat al-‘aqd) and an invalid nikah (nikah fasid). Where the prohibition was not known, lineage is established by consensus; where the prohibition was known, there is disagreement: the Imam (Abu Hanifa ﵀) holds it established, while the Sahibayn ﵏ deny it.
