Why is halala imposed on the woman?
Question
My husband gave me three talaqs. Now both my husband and I are willing to marry again, but the Shari‘a rules that without halala a nikah with the first husband is not valid. So the question is: it was our husband who made the mistake by giving us talaq — why then has the Shari‘a given the woman this ruling, that we must look upon the face of another man or marry someone else?
Answer
The husband made the mistake of giving three talaqs, and now it is he who wants to marry again. For this the ruling is that until that divorced wife marries another man with a proper nikah and shares his bed, a new nikah with the first husband cannot take place.
