Swearing by talaq when one has no wife
Question
Suppose Zayd swore this oath: “اگر آج سے میں یہ کام کروں تو جب تک میں ایک ہزار روپیہ غریبوں کو نہ تقسیم کروں، میری بیوی پر طلاق مگر کسی عذر کی بناء پر کرلوں تو اسکا کچھ اعتبار نہیں ہے” (“If from today I do this thing, then until I distribute one thousand rupees to the poor, talaq on my wife; but if I do it on account of some valid excuse (‘udhr), it does not count”) — these are Zayd’s words.
Answer
If Zayd had no wife at the time he swore, then no talaq will occur by acting contrary to this oath — whether he marries after breaking the oath, or marries first and breaks the oath afterwards; he should be completely free of worry about talaq.
