The Ruling on Talaq by the Words “Not Keeping the Wife”

Question

Question: A young man and the father of his wife (madkhul biha — with whom the marriage has been consummated) are sitting together, and the wife’s father said to the young man: «اگر تجھے ہماری لڑکی رکھنی نہیں تو ہم اپنی لڑکی کو لے جائیں گے» (“If you are not to keep our daughter, we will take our daughter away”). In reply the young man says: «نہیں رکھنی» (“Not keeping”). After some time another person says to the young man: «کچھ اور سوچ لو» (“Think it over some more”).

Answer

If the husband said this with the intention of talaq, an irrevocable (ba‘in) talaq has taken effect; thereafter, no new talaq took effect by saying it the second and third time.
