A Signature on a Divorce Deed Obtained by Deception
Question
Question: ‘Abd al-Husayn’s wife said to ‘Abd al-Husayn: “A jinn comes to me who has entered into your and my nikah; so go and write a divorce deed at the court, so that the jinn is divorced — after that you and I are still husband and wife.” And for 15–20 days after the writing they did remain husband and wife. ‘Abd al-Husayn is a plain, simple man.
Answer
Clarification (tanqih): Send the divorce deed or a copy of it, and also write quite plainly whether only a signature was taken on the divorce deed, or whether talaq was also made to be pronounced with the tongue — the one written on the paper, or less or more than it; and also send a copy of the decision that the judge of the court gave.
