Talaq by Signing a Paper Without Reading It

Question

Zayd married Hinda about two years ago. From the very first day Hinda lived with Zayd and fulfilled her marital duties. About two months ago Hinda went to visit her mother, as is customary and as women usually go. A few days later, when a request was made to bring Hinda back, Hinda’s mother made excuses, refused to send Hinda to her husband Zayd, and expressed an intention to have certain conditions accepted.

Answer

In this case neither has talaq taken effect nor has the mahr been forgiven; the nikah remains in force, and the mahr also remains due. Let no injustice be done to either of them, husband and wife; and since both of them, husband and wife, are willing to live together, no attempt whatsoever should be made to separate them — rather, she should be sent to her husband; otherwise…
