The Word “Talaq” Used as Abuse
Question
Zayd, provoked by some shortcomings of his wife, said the word talaq three times: “طلاق طلاق طلاق” (“talaq, talaq, talaq”). When his anger cooled, Zayd said: “I did not say it with the intention (niyya) of talaq, but said it as abuse.” So in this case, will talaq occur or not?
Answer
Since he said the word talaq three times with regard to his wife, then even if he said it as abuse and had no intention of giving talaq, a major (mughallaza) divorce has still taken place. Now there is no room even for a renewed nikah without halala.
