Talaq Pronounced Many Times

Question

A woman named Jannat, aged 21, is able to state on oath, regarding God as present and seeing: I have been in the marriage of ‘Abd al-Rashid for about 4½ years. During this whole period my father-in-law, for about six months while he was alive, provided for all my expenses. After his death my said husband abandoned the marital rights — such as food and maintenance (nafaqa) and night-time seclusion — and formed relations with other women of the bazaar who ply that trade.

Answer

(1) In the situation asked about, talaq has taken effect according to the Shari‘a. (2) The days of ‘idda will be counted from the very date on which he gave talaq. (3) If the husband admits the talaq, or witnesses are available — at least two upright (‘adl) men, or one man and two women — then after the ‘idda a nikah elsewhere is valid according to the Shari‘a. (4)
