The Penalty for Intercourse during Hayd through a Misunderstanding
Question
A woman’s habit (‘ada) of hayd was four days. As usual, on the fourth day at five o’clock in the afternoon the hayd stopped, and that day she also performed ghusl. That same night, at approximately 11 o’clock at night, her husband had intercourse with her. In the morning it became known that blood was flowing — approximately after the intercourse at night.
Answer
In this case, according to the Hanafis, no sin, nor sadaqa and the like, is incumbent upon them according to the Shari‘a. Whatever happened through misunderstanding — let them repent and seek forgiveness for it.
