The Husband’s Zina Does Not Make His Nikah with His Wife Fasid
Question
Zayd’s lawfully wedded wife is Sharifa. If Zayd, while married, commits zina with Hind, will Zayd’s nikah with Sharifa remain in force, or will the nikah be dissolved? And will the children born of his lawfully wedded wife Sharifa be illegitimate or legitimate? And will only Zayd be a sinner?
Answer
The nikah is not severed by this, but it is a sin. The children will not be illegitimate; rather, their lineage (nasab) will be established.
