Marrying a Righteous Girl to a Sinful, Dissolute Man
Question
Question: A brother deceitfully brought his half-sister from her mother’s house to his own house. The girl’s half-brother is of a sinful and dissolute kind (fasiq, fajir), and all his companions too were people of the same kind. The girl’s brother, forcibly, in a state of intoxication, threatening to kill the girl, forcibly obtained her permission for nikah and had her nikah performed with a man who was at that time in a state of intoxication. The girl has obtained a divorce through the court.
Answer
If the girl is pious and righteous (saliha), and the man to whom she was married is a sinful, dissolute drunkard, then according to the Shari‘a this nikah was not contracted at all; then she had it annulled through the court, so legal protection has also been secured. And Allah knows best.
