Marriage to a Non-Equal
Question
After the death of Zayd Hashimi, his wife, while the children were still minors, married a non-equal. The entire household, her mother and brother — all were displeased with her and admonished her, but she did not desist from the nikah. This nikah with a non-equal caused a great uproar; redress was even sought, but there was not so much as a hearing.
Answer
From the estate (tarika) of the late Zayd Hashimi (whether a house or anything else), the said woman is entitled, by right of marriage, to one eighth; if the mahr is still outstanding, she is entitled to it as well.
