A Girl Appoints a Young Man as Her Agent for Nikah

Question

Muhammad Abu’l-Kalam and Hashmat Ara are paternal cousins, and they wish to marry each other; both are also adults. Because of obstruction from the family regarding the nikah, one day the two met in private, and Hashmat Ara said to Abu’l-Kalam: “I have accepted you as my husband, and you have complete authority over me: at whatever time and in whatever way you wish, you may take steps concerning me. I have made you my agent (wakil) in every matter.

Answer

Since Hashmat Ara, while an adult, appointed her paternal cousin as her agent (wakil), giving him authority for the nikah, and on the basis of this agency her paternal cousin Abu’l-Kalam contracted her marriage to himself in the presence of two witnesses, in such a way that he was agent on her side and principal (asil)
