Relations with One’s Son’s Wife

Question

A man, in the absence of his son, committed an unlawful act with the wife of his own son. This woman became pregnant by her father-in-law with an unlawful pregnancy. She was sent to the son, and when this matter came to light he turned her out back again. After the days of pregnancy had passed, a boy was born.

Answer

In the case asked about, his wife has indeed become haram for the son, but it is not permissible for this woman to enter into nikah without the qadi’s separation (tafriq) or without mutaraka (formal abandonment).
