Prohibition by Affinity on the Basis of Mere Supposition
Question
(1) Hinda, once while quarrelling with her mother-in-law, says: “Tomorrow you will slander me even further — that is, that your relationship with Bakr is illicit.” Bakr, hearing this, smiled. (2) Zayd was on a journey together with his wife when Bakr, i.e. Zayd’s father, came to visit and stayed fifteen or twenty days. During those days Hinda served Bakr diligently.
Answer
If Zayd is certain about Hinda — that she is truthful in her statement — then she has not become haram for Zayd, and the nikah remains as before. However, there should not be so much familiarity and mixing with Bakr; this needs to be dealt with. And if Zayd is not certain about Hinda, but rather has a preponderant supposition (zann ghalib)
