Prohibition by Affinity Does Not End the Nikah
Question
[ar]إذا زنى أحد مع امرأته بنت امرأته أو بنته، أي بنت الزوجة والزوج معًا، هل امرأته حلال أم حرام؟ وإذا كان حرامًا هل يبقى طلاقها ونكاحها؟[/ar] “If someone, having a wife, commits zina with his wife’s daughter or his own daughter — that is, the daughter of the wife and the husband together — is his wife lawful or unlawful? And if she is unlawful, do her talaq and nikah remain?”
Answer
[ar]من زنى بإحدى من ذكرت في السؤال حرمت عليه زوجته، ولكن لم يرتفع النكاح بعد، فعليه أن يفارقها فراقًا تامًّا.[/ar] Whoever commits zina with one of those you mentioned in the question, his wife becomes prohibited to him, but the nikah has not yet been lifted; so he must separate from her completely. In “al-Durr al-Mukhtar” it says: [ar]وحرم بالصهرية أصل مزنية…
