The Ruling on a Daughter Born of Zina
Question
What do the scholars of religion say regarding this matter: a married woman left her husband and, without his consent, sat in the bazaar and took up an indecent trade. A man named Zayd, out of a sense of honour before the community and shame, took this woman into his house, and the community broke off relations with him on this account. In this state a girl was born to her. Later, after paying a fine and asking forgiveness, Zayd was readmitted into the community, but that woman is still with him as before.
Answer
The nikah of a boy or a girl born of zina with another person is valid, provided there is no other Shari‘a impediment. Likewise, performing her nikah is permissible. A monetary fine is not permissible; for admonition (tanbih), if there is a Shari‘a need for it, other means should be used — a boycott and the like.
