Marriage of the Adulterer’s Son to the Daughter of the Woman with Whom He Committed Zina
Question
A certain ‘Abdullah Shaykh states: “I committed zina with a certain Fazli while both of us were married. After some time a daughter was born to Fazli while her own husband was present, and a son was born to me. We married the two of them to each other.” What is asked is: is this nikah permissible or not?
Answer
Because of the sin of ‘Abdullah Shaykh and Fazli, the nikah of their son and daughter with each other is not impermissible; rather, it is permissible. Indeed, even if ‘Abdullah Shaykh and Fazli were to marry each other — when Fazli is neither in anyone’s marriage nor in ‘idda — the nikah of the mentioned children of the two would still be valid.
