Marrying the Mother or Daughter of a Woman with Whom Zina Was Committed

Question

Zayd committed zina with both a certain Hinda and her daughter. Now Zayd wishes to contract a nikah with one of the two. According to the Shari‘a, is a nikah with the mother permissible, or with the daughter, or is it not permissible with either of them?

Answer

A nikah is not permissible with either of them: [ar]وَمَنْ زَنَى بِامْرَأَةٍ حَرُمَتْ عَلَيْهِ أُمُّهَا وَبِنْتُهَا[/ar] “Whoever commits zina with a woman, her mother and her daughter become prohibited to him” (“al-Hidaya”, vol. 1, p. 289).
