The Nikah of a Woman After She Embraces Islam
Question
A non-Muslim woman had been married according to her own religion at the age of seven. However, until puberty she never went to her husband’s home nor formed any relationship with him. After that she began living in the house of a Muslim and, having become Muslim, was married to him that same day. Her brothers wanted to marry her off elsewhere. Four years after the marriage she had a son. Is the nikah performed after her acceptance of Islam valid or not?
Answer
When a married woman (whether the marriage was consummated or not) accepts Islam in dar al-harb, her nikah is annulled once three menstrual periods have passed. Then, if the marriage was not consummated, no ‘idda is wajib upon her; rather, after the annulment of the nikah, nikah with her becomes valid.
