The Nikah of a Newly Converted Woman Before the ‘Idda
Question
Hinda accepted Islam and, immediately after entering Islam, she wishes her nikah to be concluded with Zayd (who is a Muslim by family), and Zayd too is willing. However, according to the Shari‘a, permission for nikah has been given only after a period of three menstrual cycles has passed. In this case, if the local qadi (the official who performs nikah) recites the nikah at the insistence of both of them, will the nikah be valid without any dislike (karaha)?
Answer
If she has a husband, then her nikah immediately is not valid; she will be sinful for it, the man will be sinful, and the respected qadi will also be sinful. After accepting Islam (if the husband does not become Muslim), she will become separated (ba’ina) once three menstrual periods have passed; thereafter three menstrual periods will be required as ‘idda.
