Nikah by Means of Writing
Question
A minor girl who, in terms of her biradari (kinship community), is an Ansari, without any compulsion, pressure or inducement, willingly sent to an adult married young man, a Siddiqi, a letter stating: “I, so-and-so daughter of so-and-so, have given myself in nikah to so-and-so son of so-and-so for such-and-such a mahr.
Answer
According to the Shari‘a, this nikah has taken place validly. The girl’s repudiation of her letter after the nikah and intercourse carries no weight in the Shari‘a, and her calling her husband her brother has had no effect on the nikah.
