The Testimony of the Father and Brother in a Nikah

Question

A relationship was formed between a man and an unrelated (ajnabiyya) woman. When on one occasion the girl’s letter was intercepted, the relationship came to light. Now the girl says: “My marriage already took place on the 15th of Ramadan at twelve o’clock at night; my father and brother are witnesses.” Will her nikah be established or not?

Answer

If the offer and acceptance of the nikah took place in the presence of the father and the brother, then this too suffices for the validity of the nikah. Other people should now not pry, and should be content with the testimony of these two.
