Is It Necessary to Mention the Father’s Name at the Nikah?
Question
Is it necessary in a nikah, at the time of offer and acceptance, to mention the name of the father of the bride and groom? As to the first part: if the name was not mentioned, whether by oversight or deliberately, will the nikah have to be performed again? As to the second part: how will the nikah of a child born of zina (walad al-zina) or of a foundling (laqit) be performed?
Answer
If, even without mentioning the father’s name, the qadi and the witnesses all recognise them and no ambiguity remains, the nikah will still be valid. For example, both are present in person in the gathering and themselves make the offer and acceptance before the witnesses; or their guardian (wali)
