Is a ruling of the Imarat-e Shar'iyya a qadi's judgement?

Question

Question: The Imarat-e Shar'iyya (Shari'a Emirate) is established in the province of Bihar, and under the Imarat-e Shar'iyya dar al-qadas (Shari'a courts) have been established in various districts and various sub-divisions, and qadis appointed. Cases of annulment of nikah (faskh) and the like are filed in these courts, and the qadi of the dar al-qada, after hearing the apparent statements, proofs and evidence of the plaintiff and the defendant, decides the case.

Answer

The system of the Imarat-e Shar'iyya is an excellent system: it carries many Shari'a and social benefits and protects from countless harms. Muslims should not turn away from it without a Shari'a reason, but should have their cases decided there.
