The Shari‘a emirate (Imarat-e Shar‘iyya)
Question
Question: You must be aware that in our province of Bihar, for about 20 years, a few people have established an “Imarat-e Shar‘iyya” (Shari‘a emirate — a Shari‘a-based leadership of the community), and all the people are opposed to it. (1) The preachers of the aforementioned imara keep preaching among the common people that whoever does not accept the orders of the imara will die the death of ignorance, misguidance and kufr. Is this correct? (2) (alif) Is establishing an amir and an imara fard or wajib? (ba)
Answer
(1) I have not investigated the circumstances of the said imara, nor am I acquainted with its members; when its principles, rules and the structure of its establishment are not before one, it is difficult to form any opinion. Nevertheless, insofar as your questions relate to the Shari‘a, the answer to them is written down.
