Bringing soil from a grave

Question

Is it permissible to bring soil from the grave of saintly elders or not?

Answer

The graveyard from which soil is brought cannot fall outside two cases: it is either waqf (mawqufa) or privately owned (mamluka). If it is waqf, [this] contradicts the intent of the endower (waqif), and is therefore impermissible. If it is owned, then again it cannot fall outside two cases: [the soil] will be brought either with the owner’s permission or without permission.
