Evicting a tenant from a house or shop
Question
Question: Is it permissible according to the Shari‘a to collect an increased rent from the tenant of a house or shop, or can the house and shop be vacated by the tenant? For nowadays there is a government law that a shop can neither be vacated nor the rent increased. If a Muslim neither increases the rent nor vacates, will he be held accountable before Allah?
Answer
The owner of the shop or house has the right, once the term for which the rental contract was made has elapsed, to have the tenant vacate; he also has the right to make a contract at an increased rent.
