The tenant’s right to extend and build in a rented house

Question

Question: A certain person, Ghulam Muhammad, lives in a rented house. He had two garages built in it and, taking 9000 rupees in advance, gave them to Hidayat at 1-110 (?) monthly. Because of this the municipal board tax increased, and the owner of the house resorted to the court to have the house vacated, and the dispute grew. Ghulam Muhammad’s brother-in-law (his sister’s husband)

Answer

The Sharʿi ruling is this: for whatever period the house was taken on rent, on completion of that period, if the owner wants it vacated, it should be vacated. Without the owner’s permission and consent it is not permissible for the tenant to keep possession of it and not vacate it; moreover, he has no right to make it a source of his income and to let it to others.
