Renting out one’s land to a firm

Question

Question: Is it permissible to rent out property to a firm, knowing that it will conduct a Hire Purchase business in that place? And if such property is part of an estate (tarika) in a state in which a “hire purchase” business is already being conducted in it, what is the position then?

Answer

According to the Imam A‘zam it is permissible — “and this is the broader view” (وهو الأوسع) — while according to his two companions (the Sahibayn) it is makruh: [ar]وهو الأورع. وجاز إجارة بيت ليتخذ بيت نار أو كنيسة أو بيعة أو يباع فيه الخمر، وقالا: لا ينبغي ذلك[/ar] “And this is the more scrupulous view (awra‘).
