Accepting a present from a minor child
Question
Question: Is it permissible to accept a present (hadiyya) from a minor or not? In “Tadhkirat al-Khalil”, in the account of the journey for Hajj and the visit to the city of the Messenger ﷺ, it is written that it is permissible, while in “Bihishti Zewar” (“Heavenly Ornaments”) it is written that it is not permissible for a mother to take her minor daughter’s head-covering on loan (musta‘ar) for a short while and go somewhere.
Answer
If a minor gives a present out of his own property, it is not permissible to accept it: for permissibility, puberty is a condition. If the parents give of their own property and tell the minor, “Give this present to such-and-such a person,” then it is valid to accept it, because in reality it belongs not to the minor but to the parents.
