Filing a false lawsuit to escape a false lawsuit
Question
When, according to the fatwa of Hazrat Thanawi ﵀, a false claim or testimony of qisas (?) is permissible to ward off oppression, protect a right and the like, why is it not permissible to free oneself from a false lawsuit by filing a false lawsuit against the oppressor?
Answer
Freeing oneself is permissible, but in deliberately doing so, firstly, there will be explicit lying, which is in itself a sin; secondly, it primarily (asalatan) involves entrapping another person, and freeing oneself only as a consequence (luzuman); and this consequence too is not certain but merely probable; moreover, transgression (ta‘addi) in it is most likely.
