The wife’s right over her husband regarding intercourse
Question
A certain person, while explaining a ruling, said: after marriage it is necessary to have intercourse with one’s wife only once, and for the rest of one’s whole life it is a voluntary act (tabarruʿ). Is this ruling correct or not?
Answer
Its meaning is that if he has had intercourse once, the woman does not have the right to have the nikah annulled (faskh) by submitting an application to the qadi’s court saying, “My husband is impotent; let me be permitted a second nikah.” Otherwise, as a matter of conscience (diyanatan)
