When is the property of a safih to be handed over to them?
Question
Question: Zayd passed away a few years ago; his property and estate have not yet been divided among the heirs. They are now about to be divided. Among the heirs is also his sister, and she is a safih (one lacking sound judgement in handling property), that is, she does not have the ability to distinguish good from bad. There is a strong fear that, owing to her lack of judgement (safah) and the incitement of a few greedy people, she will squander the entire property.
Answer
If the sister is an heir according to the Sharia, and she is a safih, and there is a strong likelihood that she will squander her property to no purpose, then the family members, by mutual consultation, should hand (her share)
