The condition of taking paddy in exchange for the rupee in a salam sale
Question
Question: A person — today rice is, for example, 8 seers (a unit of weight, ≈ 0.93 kg) to the rupee — says to the buyer: “After two months I will take from you 32 seers of paddy (unhusked rice) in exchange for this rupee.” Whoever takes the rice on this condition is the one it is given to, and anyone else cannot get it at this price. In such a case, is this transaction permissible according to the Shari‘a or not?
Answer
This sale is not permissible. The way to make it permissible is that the transaction for the rice be concluded without the stated condition; then the one rupee that becomes due as its price — it is best that it be paid, and if one does not have it oneself, it may be borrowed from this seller or from someone else and paid.
