Ruling on one who does not believe a person swearing by the Qur’an
Question
Question: Zayd says that one who swears by the noble Qur’an or the noble Ka‘ba must certainly be believed, and whoever does not believe him is a kafir. But Bakr says that swearing by anything other than the Most Holy Lord is not permissible at all, so how can he be believed? Will he be regarded as a liar?
Answer
This much of what Bakr says is correct: swearing by anyone other than the Most Holy Lord (His Essence and Attributes) is not permissible. However, the fuqaha’ have written that swearing by the noble Qur’an also constitutes a valid oath, as stated in Fath al-Qadir, al-Bahr and elsewhere. Yet declaring someone a liar without reason is not right.
