‘Ushri and Kharaji Land
Question
Is the land of India — especially the land of the new settlements, for example in the region of Multan, Montgomery and the like — ‘ushri or kharaji? After setting out its correct definition, please explain what the form of zakat on the produce of these lands will be. Write in some detail on what kind of land ‘ushr is wajib and what its ruling is; is there also some division into ‘ushri and kharaji land, or is it general?
Answer
Land that has been with a Muslim since the time of Islamic rule and is watered with ‘ushri water is ‘ushri. Its ruling is that ‘ushr is wajib on its produce.
