A Madrasa in the Mosque’s Gallery and a Society’s Office in Its Galleries
Question
(1) A second elementary religious school has been running in the Moti Masjid for many years, in which Qur’an reading from the text and religious education are taught in Urdu and Hindi; only boys study in it, and men, most of whom are ‘ulama’, teach. It is set up in the northern and southern galleries under the name of a branch of the “Madrasa Islamiyya ‘Arabiyya”. The Shahi Awqaf (state endowments administration) of Bhopal dislike this and want to remove it. Is this knowledge (?) correct according to the Shari‘a?
Answer
(1) If this is in accordance with the intention and consent of the waqif (endower), then it should by no means be removed; otherwise, a rental arrangement should be made for it. (2) It is not correct to put any part of a gallery that is waqf for the needs of the mosque to any other use. If it is to be used for the stated need, it should be taken on rent.
