Converting a Mosque into a Madrasa

Question

In our town, twelve years ago, after an announcement was made in all the Muslim neighbourhoods, a mosque was founded under the name “Haydar Ali Tipu Sultan Congregational Mosque”. Since then the five daily prayers and the Friday khutba have been held in the mosque regularly. Now a proposal has come before the mosque’s management committee: since, on the mosque’s side, across the road that passes in front of the mosque, non-Muslims have built a small mandir (a Hindu temple)

Answer

Since it has become a mosque in the Shar‘i sense and the adhan and congregational prayer (jama‘a) are being held there, it is now by no means permissible, on account of the considerations mentioned, to turn it into a madrasa and, removing the mosque from there, to transfer it under its name to another place. It is a mosque for ever and ever.
