Removing a mutawalli without cause

Question

Question: (1) There is a large Muslim population here, and there is a mosque here. Earlier a respected Hajji had the mosque built and did not endow any property or the like. Later some people spoke to a Hindu Maharaja, and he gave fifteen acres of land for a graveyard, a school [and] a mosque.

Answer

(a) If the Anjuman-i Islamiyya is registered, manages properly, does not squander the income of the waqf and there is no irregularity in the accounts, then the Waqf Board has no right to take [the waqf] from it by force — neither by law nor by the Shari‘a. Legal measures should be taken for protection against this. (b) The ruling on this is the same as for No.
