Depositing mosque funds in a donation fund instead of with the mutawalli because accounts are not given
Question
Question: Here in the town people often have complaints about the mutawallis (trustees) of mosques, since some mutawallis do not give the residents of the neighbourhood an account of the mosque’s income and expenditure, and embezzlement (khiyana) has even been proven against some mutawallis.
Answer
(1) If embezzlement (khiyana) by the mutawalli of the mosque is proven, then proof of it should be presented through the governing authority in due form and he should be removed from the trusteeship (tawliya); but if it is mere suspicion and conjecture, without proof, he should not be removed.
