What should the mutawalli of a waqf be like?

Question

Question: 1. Is it necessary for the trusteeship (tawliya) of a mosque that one be observant of the Shari‘a (mutasharri‘) or not? If a religious (mutadayyin) Muslim is available, what is the ruling on passing him over and unjustly making someone who is not religious the mutawalli? 2. What level of Muslim should the mutawalli of a mosque be? 3. What is the ruling if the waqif (endower) of the property himself is declared the mutawalli?

Answer

1. The person made mutawalli should be one who is trustworthy (amin) (not treacherous), religious (not irreligious), and who has the competence for and interest in managing the waqf. Removing such a person without reason, or appointing from the outset some sinful (fasiq)
