Opening a Hospital with Eidgah Funds
Question
Question: (1) In Muzaffarnagar there is considerable income from the shops of the Eidgah (the open-air place of the Eid prayer). The Eidgah is insufficient for the worshippers: a considerable number of worshippers end up on the road, and their direction also deviates completely from the qibla. There is so much money that the Eidgah could be made two-storeyed. In this situation, is it permissible or not to open a hospital with the Eidgah’s money? (2)
Answer
(1) The money that has been collected as donations for the Eidgah, or that has been obtained from the waqf of the Eidgah, may not rightly be spent on a hospital or used to open a hospital: this is contrary to the intention of the donor and the intention of the waqif (endower), and the mutawalli (trustee) has no such right. The mutawalli is a trustee (amin)
