Building a madrasa on land endowed for a mosque
Question
Question: A man made a house a waqf in the name of a mosque through the court; about 20 or 22 years have passed since then. Now a few members of the managing committee of the Akhtar Mosque, without any consultation, evicted the tenant from that house through the court and began to have a madrasa built there, and whatever income the mosque had has ceased. Please write whether this is permissible or impermissible according to the Shari‘a.
Answer
It is not permissible to build a madrasa on a house endowed for a mosque and thereby put an end to the mosque’s income.
