Making all of one’s property a waqf
Question
Question: Five years ago a man made almost all of his agricultural land a waqf in the name of the Awqaf Committee of Bandipura. This man passed away a week ago. The question now is: (a) Is this waqf deed valid? And can his heirs object to the waqf after his death? The deceased has neither children nor wife, and neither his parents nor any of his brothers are alive; there are, however, a paternal uncle, paternal cousins and some maternal cousins. (b)
Answer
(a) The owner appointed the Awqaf Committee as mutawalli (trustee), made his agricultural land a waqf and handed it over into the possession of the mutawalli; five years have passed since then, and the Awqaf Committee is spending its income on charitable purposes in accordance with the wish of the waqif (endower).
