Can a Co-owner of Joint Property Make His Share a Waqf?
Question
If any of us brothers wishes to make his share a waqf in the name of some religious institution, may he make the waqf or not? Can anyone annul this waqf or not?
Answer
From joint property, whoever wishes may sell his share or make it a waqf; no co-owner has the right to object. Once the waqf has become complete (tamm) and binding (lazim), it cannot be annulled.
