The ‘idda of a woman divorced by an impotent man (‘innin)

Question

Question: Hinda’s husband is well known to be impotent. Now the said husband has given Hinda talaq. Does she have an ‘idda or not? And if she does, how long is it?

Answer

(1) If he gave talaq after a valid seclusion (khalwa sahiha), that is, seclusion between husband and wife has already taken place, then an ‘idda of three menstruations is wajib upon her; otherwise not, that is, if he gave talaq before seclusion, there is no ‘idda.
