The husband may conduct the nikah for halala
Question
(1) There were constant quarrels and wrangling between my grandmother (paternal) and my wife; once or twice it even came to blows. Despite my countless admonitions the wife did not desist, and so I set this condition: “If after today you quarrel with the respected Grandmother, then for you not three but six talaqs.” And on the day I set this condition, the quarrel did not come to blows.
Answer
(1 and 2) With the condition having been met, a major (mughallaza) divorce has taken effect. After the passing of the talaq ‘idda — three menstrual periods — if the divorced woman agrees to marry another man and the former husband (the one who gave the talaq) conducts the nikah, that too is valid.
