Arranging Halala for Money

Question

Question: Here many people give their wives three talaqs, and then, paying some man, marry the woman to him; that man, under a pre-arranged agreement, pronounces talaq after a day or two, and then, after the woman’s ‘idda has passed, marry her themselves. Is this nikah valid or not, and is it permissible to do this or not? We hope you will kindly grant a detailed answer, so that the Muslims here may receive guidance.

Answer

Contracting a nikah on the condition that talaq will be pronounced after a day or two is makruh tahrimi and a sin, although through such a nikah, if talaq is pronounced after consummation (dukhul, i.e. intercourse), the woman will become lawful for the first husband, provided the second nikah is contracted after completing the ‘idda.
