Talaq in Writing: Signing an Unread Document

Question

Question: Zayd said to his nephew (his sister’s son) Khalid: “If the nikah of my niece (my sister’s daughter) Hinda takes place into any of the tribes of ‘Umar and Bakr through your force and compulsion, three talaqs will fall; and you will also have to write a document to this effect.” Khalid replied: “I will write such a document.

Answer

(1, 2) If Khalid signed after becoming aware of the content of the document, and he also admits it, then this document is valid in the Shari‘a, i.e. once the condition occurs, talaq will take effect: [ar]رجل استكتب من رجل آخر إلى امرأته كتابا بطلاقها وقرأه على الزوج فأخذه وطواه وختم وكتب في عنوانه وبعث به إلى امرأته فأتاها الكتاب وأقر الزوج أنه كتابه فإن الطلاق يقع عليها.
